On-line Sale of Mah-jong Bearing LV Logo Does Not Constitute Trademark Infringement
2008/07/24 TaiwanOn May 20, 2008, a 27-year-old woman, Ms. Huang placed a set of Mah-jong bearing the fashion trademark LV (owned Louis Vuitton) on Yahoo’s online auction platform for sale. Based on the understanding of that LV is a registered trademark in Taiwan, the police pretended to be an interested customer and arranged the purchase of the set of Mah-jong in person with Ms. Huang. After Ms. Huang showed up, the police arrested her for alleged trademark infringement. However, as the registered trademark LV in Taiwan does not designate the goods of Mah-jong, the Shihlin District Prosecutors Office concluded that Ms. Huang’s act does not constitute trademark infringement and dropped the charge against her.
